Legislative Update - positive response from U.S. Senator John Kerry ---------------------------------------------------------------------- [Rich Eichinger & Yvonne Cook got the following response from their visit to the offices of Senator John Kerry (Massachusetts). He appears uncomfortable with the mix of state laws, but recognizes that change will be difficult. Obviously, our goal is to help our representative see that it is worth the effort!] November 2, 2001 Thank you for contacting me to share your concerns about family rights. I strongly believe in the primacy of the parent-child bond and deeply regret hearing of cases in which that bond has been jeopardized. Determinations of parental rights and child custody arrangements are made on a case-by-case basis through state court proceedings (except in rare circumstances in which Federal law and Federal courts might be implicated). Under this system, in accordance with the requirements of the Constitution, we entrust the courts with responsibility to ensure that the best interests of our children are served. For complex historical, and Constitutional reasons, each state makes its own laws concerning child custody matters. While it might be more consistent to have Federal legislation similar to that which you advocate through the Family Rights Act, there are many Constitutional considerations which could stymie the enactment and enforcement of such legislation by the Federal government. Nevertheless, I recognize and appreciate the concern that you have expressed for your children, and I assure you that I will continue to fight on behalf of America's young people while on Capitol Hill. Declaration of AKidsRight - from the Declaration of Independence. ------------------------------------------------------------------- [The following was submitted by Rich Eichinger(rae1275@cswebmail.com), in case you are wondering about the numbers, those are his kid's ages, 12, 7, & 5. He changed a few words within our Declaration of Independence and submits them for your review. Remember what caused a "revolution", taxation without representation and tyranny. How do you think the founders of this Nation would have responded to British Judges separating Parents/Children, or even delegating those decisions to social workers? As members of AKidsRight, this is certainly not a call to an "armed struggle" as occurred in 1776. No violence needs to be used in the effort to become equal parents, but we need to demonstrate our Faith, Love, and willingness to Sacrifice. It certainly is a call to re-examine ourselves and the personal sacrifices required to make real change happen.] ------- Declaration of AKidsRight WE hold these Truths to be self-evident, that all People, Parents and Children among them, are created equal, that their Creator with certain unalienable Rights endows them. Those among these are Life, Liberty and the Pursuit of Happiness. To secure these Rights, Governments are instituted among People, deriving their just Powers from the Consent of the Governed. And, whenever any Form of Government becomes destructive of these Ends, it is the Right of the People to alter or to abolish it. It is the right of the People to institute new Government, laying its Foundation on such Principles, and organizing its Powers in such Form, as to them shall seem most likely to effect theirs and their Children's Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient Causes; and accordingly all Experience hath shown, that Children when young and older when Parents are more disposed to suffer, while Evils are sufferable, than to right themselves by abolishing the Forms to which they are accustomed. But when a long Train of Abuses and Usurpation, pursuing invariably the same Object, evinces a Design to reduce them under absolute Despotism, it is their Right, it is their Duty, to throw off such Government, and to provide new Guards for their future Security. Such has been the patient Sufferance of these Children; and such is now the Necessity, which constrains them to alter their former Systems of Government. The History of the present Family Law Courts is a History of repeated Injuries and Usurpation, all having in direct Object the Establishment of an absolute Tyranny over Children.
